STANDARD TERMS AND CONDITIONS OF SALAMA-STORE

Please read these Terms and Conditions carefully before making any purchase from Salama-Store. By using our services or making a purchase, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services.

1. Definitions

  • "Seller" or "We" / "Us": Refers to Salama-Store, an online e-commerce platform.
  • "Buyer" or "You": Refers to the person or entity placing an order for Products or Services from the Seller.
  • "Products": Refers to the goods or services offered for sale by the Seller through its online platform.
  • "Order": Means the purchase order submitted by the Buyer to the Seller.
  • "Website": Refers to www.salama-store.net.

2. Scope of Application

These Terms and Conditions apply to all sales and supplies of Products made exclusively through the Salama-Store online platform, between the Seller and the Buyer, and form an integral part of any sales agreement, unless otherwise expressly agreed upon in writing.

3. Quotations and Orders

  • Order Acceptance: An Order is binding on the Seller only upon written confirmation (via email or order confirmation message on the Website). The Seller reserves the right to refuse any Order for any reason whatsoever.
  • Prices: All prices displayed on the Website are subject to change without prior notice. The applicable price is the price displayed at the time of Order confirmation. Prices do not include shipping fees or applicable taxes, unless expressly stated otherwise.
  • Pricing Errors: In the event of an obvious error in the pricing of Products, the Seller reserves the right to refuse or cancel any Order placed at the incorrect price.

4. Payment

  • Full payment must be received before the Products are shipped, unless other payment terms are agreed upon in writing.
  • Accepted payment methods are (Credit/Debit Cards, Cash on Delivery (COD), Bank Transfer, Online Payment Gateways).
  • In case of non-receipt of payment, the Seller reserves the right to cancel the Order or suspend shipment.

5. Shipping and Delivery

  • Delivery Service: Salama-Store operates as an online platform that arranges for the delivery of Products directly to the Buyer's specified address.
  • Delivery Times: Delivery dates provided are estimates only and are not guaranteed. The Seller is not responsible for any delays in delivery caused by circumstances beyond its control (e.g., shipping carrier issues, force majeure events, or unforeseen logistical challenges).
  • Cost: Shipping costs are borne by the Buyer, unless free shipping is explicitly agreed upon or offered as part of a promotion.
  • Risk: Risk of loss or damage to the Products passes to the Buyer upon delivery of the Products to the shipping carrier.
  • Receipt: It is the Buyer's responsibility to inspect the Products immediately upon receipt. Any damage or shortage must be reported within (3 hours of the delivery date).

6. Return, Exchange, and Cancellation Policy

  • Returns and exchanges of Products are (3 days from the delivery date).
  • Order cancellation requests are subject to the Seller's approval and may incur a cancellation fee, depending on the Order status.

7. Warranties and Disclaimers

  • Product Warranty: The Seller warrants that the Products will be free from defects in materials and workmanship for a period of (15 days from the date of delivery), unless a specific product warranty is otherwise stated. This warranty is limited to repair, replacement, or refund at the Seller's discretion.
  • Disclaimer: To the fullest extent permitted by law, the Seller disclaims all other warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.
  • Limitation of Liability: In no event shall the Seller be liable for any indirect, incidental, special, or consequential damages (including loss of profits) arising out of the use or inability to use the Products. The Seller's total liability, in any case, shall not exceed the amount paid by the Buyer for the Products in question.

8. Intellectual Property

All trademarks, logos, copyrights, and content present on the Website are the property of the Seller or licensed to it, and are protected by intellectual property laws. They may not be used, copied, or reproduced without the Seller's prior written consent.

9. Privacy and Data Protection

10. Governing Law and Dispute Resolution

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt.
  • Any disputes arising out of or in connection with these Terms and Conditions shall first be settled amicably. If an amicable settlement is not reached, the dispute shall be referred to the competent courts in Cairo, Egypt.

11. General Provisions

  • Amendments: The Seller reserves the right to amend these Terms and Conditions at any time without prior notice. Changes will be effective immediately upon posting on the Website. Your continued use of the Website or submission of Orders after the posting of amendments signifies your acceptance of the modified terms.
  • Severability: If any provision of these Terms and Conditions is deemed unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
  • Entire Agreement: These Terms and Conditions (including any policies referenced herein) constitute the entire agreement between you and the Seller regarding the sale.
